Abstrakt
Celem niniejszego artykułu jest zbadanie różnic, jakie istnieją między korzystaniem z prawa do pracy przez uchodźców i pracowników migrujących na mocy prawa UE oraz zbadanie istniejących różnic między tymi kategoriami na gruncie prawa międzynarodowego. Wiodącą metodą badawczą zastosowaną w artykule jest metoda porównawcza. Wykorzystano go do analizy różnic w regulacji prawnej i realizacji prawa do pracy przez uchodźców i pracowników migrujących w UE. Artykuł analizuje specyfikę definicji i regulacji prawnej pojęć uchodźca i pracownik migrujący. Autorzy definiują klasyfikację typów migracji i dochodzą do wniosku, że motywy ekonomiczne są najczęstszym powodem migracji. Jednocześnie autor przekonuje, że uchodźcy i migranci zarobkowi to różne pojęcia z punktu widzenia prawa pracy. W związku z tym mają różny status prawny, a co za tym idzie różne ramy korzystania z przysługujących im praw. Poza tym autorzy za przykład podają ustawodawstwo z Polski, które reguluje zarówno kwestie migracji zarobkowej, jak i realizacji praw pracowniczych uchodźców, zwłaszcza w kontekście wojny na Ukrainie, co znajduje również odzwierciedlenie w wynikach pracy i wnioskach artykułu.
