Qualification of the value of the monument in the light of the law of the United States of America

Abstract

This article examines value-based selection criteria applied in classification of historic monuments and sites in American legislation. Furthermore, the author of this article arrives at conclusions which could be applied in the Polish provisions of law. In the USA, there are two registers of historic monuments and sites, i.e. National Register of Historic Places and National Historic Landmark Register which consists of buildings, districts, objects, sites, or structures that are officially recognized by the United States government for their outstanding historical significance. In both cases, the requirements which the properties, objects, and sites to be entered into the register must meet are defined very precisely. Moreover, detailed monument valuation criteria, different for each category, can support the decision on listing a monument or site. The author of this article analyses these criteria and concludes that they could provide a basis for developing interpretation guidelines for applying provisions of the Polish Act on Protection and Guardianship of Monuments and Sites. These instructions would help historic preservation officers assess values of properties and sites. Their decisions would be therefore less intuitive and subjective but based on specific criteria. This would result in value assessments being standardised in the entire country.

prof. dr hab., ukończył studia wyższe na Wydziale Prawa i Administracji Uniwersytetu
Jagiellońskiego, a związany jest z Uniwersytetem Śląskim, gdzie przeszedł wszystkie etapu kariery
naukowej uzyskując w 2005 roku tytuł naukowy profesora. Opublikował łącznie ponad 100 artykułów
w tym około połowę w językach obcych. Jest także autorem lub współautorem 10 monografii, z których
cztery ukazały się w języku angielskim. W ramach podanych liczb ponad 80 artykułów oraz wszystkie
monografie dotyczą prawa ochrony dóbr kultury.
Wygłosił referaty na ponad 100 konferencjach w kraju i zagranicą oraz prowadził gościnne
wykłady, między innymi, w Nowym Jorku, Paryżu, Manchesterze, Weimarze, Berlinie, Warwick,
Edynburgu, Mińsku, Londynie, Wiedniu, Windsorze, Waszyngtonie, Toledo, Oxfordzie, Tartu, Wilnie,
Moskwie, Athens (Georgia, USA), Hadze, Sofii, Tokio, Nashville, Heidelbergu, Aberdeen, Hamburgu,
Hiroszimie, Maastricht, Palermo i Santiago de Compostela. Na szczególną uwagę wśród nich zasługuje
cykl wykładów wygłoszonych w 2001 roku w Haskiej Akademii Prawa Międzynarodowego, opublikowanych
następnie w odrębnym tomie wykładów Akademii pt: Restitution of Works of Art pursuant
to Private and Public International Law. Hague Academy of International Law, Recueil des cours, Vol.

Jest członkiem ICOMOS, a w ramach tej organizacji członkiem założycielem Committee on
Legal, Administrative and Financial Issues. Przez szereg lat był także współredaktorem kwartalnika:
Art, Antiquity and Law.
W okresie od 1991 do 1994 pełnił funkcję Pełnomocnika Rządu RP do Spraw Polskiego
Dziedzictwa Kulturalnego za Granicą, był wiceprzewodniczącym Komitetu Dziedzictwa Kulturowego
Rady Europy w Strasbourgu. Przez drugą kadencję jest członkiem Komisji Dyscyplinarnej przy
Radzie Głównej Szkolnictwa Wyższego. Od 1998 roku jest także związany z Ministerstwem Spraw
Zagranicznych RP, gdzie sprawuje funkcję Pełnomocnika Ministra ds. Restytucji Dóbr Kultury.
